Based on the injunctions of the Pentateuch (Torah) and the biblical prophets’ condemnation of the “licentiousness” of the pagans, the teachers of the law developed a system of rules regulating the sexual life of the Jew.

Jewish tradition approves of a woman's sexual desire and makes it a man's duty to satisfy his wife (mitzvat ona; cf. Ex. 21:10).

In principle, a healthy man, not engaged in heavy physical or mental labor, should perform his marital duties every night (except for the restrictions imposed by sexual prohibitions - see below); those who are engaged in heavy physical labor - at least twice a week; studying Torah, which requires a lot of mental effort, at least once a week (Maim. Yad., Hilchot Ishut 14:1).

At the same time, the teachers of the law demand that a man be moderate and not go beyond the scope of his duties. Sexual intercourse is prohibited on Yom Kippur and the Ninth of Av.

Self-control

Lawmakers viewed self-control in sexual life as a moral duty: “Who is strong? He who curbs his passions” (Avot 4:1); “For most people, there is nothing more difficult in the entire Torah than the requirement to abstain from lust and forbidden sexual relations” (Maim. Nast. 3:49).

To prevent dissolute behavior, representatives of the opposite sexes are prohibited from being alone (Sh. Ar. EkhE. 22), and even spouses are required to avoid lustful thoughts and immodesty in behavior (ibid., 21–25). The prohibition against wearing clothing of the opposite sex is based on Deut. 22:5.

Prohibitions

Unnatural connections

Judaism categorically prohibits unnatural sexual relations (such as homosexuality and bestiality); in the Bible they are called an abomination and abomination (toeva, tevel), with which the Canaanites disgraced themselves (Lev. 18:22–25).

Anyone who violates this prohibition must be punished by death (see Punishment), and in the case of bestiality, the animal with which intercourse took place must also be destroyed (Lev. 18:29; 20:13, 15–16; Sankh. 7:4).

The teachers of the law decreed that a seduced boy under 13 years of age should not be punished for homosexuality (Sankh. 54a).

Homosexual relations between women (lesbian love) are not mentioned in the Bible, but according to the Midrash the punishment is not death, but scourging (Sifra 9:8).

The Bible mentions homosexuality in two similar stories: the sinful city of Sodom (Gen. 19:5) and the crime of the tribe of Benjamin (Judg. 19:22–23).

In the Talmud, references to cases of homosexuality are also extremely few (TI., Sankh. 6:6, 23c; see also Ancient 15:25–30).

The rarity of homosexuality among Jews is reinforced by the story of Rabbi Yehuda's ruling that two single men should not sleep under the same blanket (Kid. 4:14); Most teachers of the law considered this ruling unnecessary and did not accept it (Kid. 82a).

Although the laws regarding homosexuality were codified by Maimonides, he also wrote: “There is no suspicion that the Jews practice homosexuality” (Maim. Yad., Issurei Bia 22:2). I. Karo, without mentioning the prohibition of homosexuality, still recommends that two men avoid solitude (Sh. Ar. EkhE. 24); however, a century later, Joel Syrkes wrote: “... in our area [that is, in Poland], such debauchery has not been heard of” (“Bait Hadash” - “New Home”, commentary on Tur. EkhE. 24).

Rabbinic sources give a number of reasons on the basis of which this prohibition became a universal law and was included in the “seven commandments of the sons of Noah” (Sankh. 57b-58a; see Laws of the Sons of Noah); homosexuality is a perversion that disgraces human dignity; it contradicts the purpose of sexual intercourse as a means of reproduction and therefore, like any shedding of seed in vain (see above), is subject to prohibition; it damages family life by turning the husband away from his wife.

Homosexuality was considered such a terrible crime that in the Middle Ages, rabbis even allowed homosexuals to be extradited to the authorities (responsibility of Rabbi Moshe Mitrani).

In the State of Israel, homosexuality is punishable by law in cases of corruption of a minor or violence.

Incest

Another strict prohibition of Judaism is the prohibition of incest (gilluy-rayot, literally 'undressing').

The punishment for different types of incest is different. Thus, the Bible prescribes burning only for incestuous relations with the mother-in-law (Lev. 20:14), but does not indicate what type of execution should be chosen in other cases (Lev. 20:11–12, 17, 19–21), and in a number These cases (Lev. 20:17, 20, 21) probably mean not the death penalty, but carets.

In the Talmud, incest is considered one of the three greatest sins (along with murder and idolatry) and cannot be justified, even when it was committed under threat of death (Sankh. 74a, etc.), for the purpose of saving the life of another person (Tos. Shab 15:17) or for any medical reason (TI. Shab. 14:4 and others).

The Talmud divides incestuous relationships into three categories: punishable by stoning (relations with mother, stepmother, or daughter-in-law; Sankh. 7:4); punishable by burning (relations with a daughter or granddaughter, stepdaughter or her daughter, with a mother-in-law or her mother; Sankh. 9:1); punishable by carriages or scourging (all others - Maym. Yad., Issurei Bia 1:4–7).

Since some of the crimes of this kind entail both judicial and Divine punishment (for example, intercourse with one's mother or stepmother; Cor. 1:1), the rule was established that the court has the right to pronounce the death penalty only when the offense has been committed in front of witnesses and after a warning that he is being punished; if there are no witnesses or the criminals have not been warned, punishment must follow from God (Maim. Yad., Issurei Bia 1:2-3).

When a crime is committed against a sleeping person, an ignorant person, or a child, he is not subject to punishment (Cor. 2:6).

Halakha does not explicitly prohibit casual sex (including prostitution), but it does condemn it, in part because in the case of children being born, ignorance of paternity in the future may lead to unintentional violations of the prohibition of incest.

Along with the prohibition of incest, Judaism imposes a ban on sexual intercourse between a “legitimate” Jew and a mamzer of the opposite sex, that is, with one born as a result of incest or adultery of the mother. Violation of this prohibition is also punishable by scourging (Maim. Yad., Issurei Bia 15:2).

Adultery

However, marital fidelity is compared to Israel's unwavering loyalty to their God, and adultery is compared to the worship of other gods (see Idolatry; Jer. 2:23; 3:1; Ech. 16:1; 23:1 and others).

Specific prohibitions

The Torah prohibits having sexual intercourse with a woman during her menstrual period (Lev. 18:19; 20:18); The punishment for violating this prohibition is carriage, to which both men and women are subjected.

If they have been previously warned and there are witnesses to the offense, the offenders are subject to scourging (I Macc. 3:1).

Also during the postpartum period, a woman is considered unclean and cannot have sexual intercourse.

Purity after menstruation or after childbirth is restored by the woman performing a ritual ablution in the mikveh (for more details, see Niddah).

Having sexual intercourse with a non-Christian with the intention of marrying him is an offense punishable by scourging. When there is no intention or promise of marriage, such an act is not a crime; in this case, the punishment of scourging can be imposed in order to admonish the offender and express censure. Castration is also punished by scourging if it involves mutilation of the external genitalia.

Specific prohibitions are imposed on the sexual life of a kohen. He is forbidden to have sexual intercourse with a divorced woman, a harlot, or one who lost her virginity before marriage, as well as with a woman born from such a relationship (Lev. 21:7); for violating this prohibition, both the kohen himself and the woman with whom he sinned are subject to scourging. The high priest cannot get along even with a widow (Lev. 21:14), otherwise he should be punished with scourging. The daughter of a kohen, caught in fornication, is subject to burning (Lev. 21:9).

In general, the Bible does not seem to prohibit prostitution except for cultic (temple) prostitution, but even in the latter case there is no mention of punishment (the law regarding the daughter of the kohen is thus an exception). The views of the Talmudic teachers on these problems differ, and there is often a tendency to tighten the law (for details, see the article Prostitution).

Rape

Rape of an unengaged girl, according to biblical law, was punishable by the fact that the rapist was obliged to pay the father of the raped woman 50 shekels in silver as a bride price and take her as his wife, without the right to divorce her in the future (Deut. 22:28–29).

The Talmud also obliges the rapist to pay compensation to the girl for the physical and moral damage caused to her (Kt. 42a-43b).

However, if the girl refuses the marriage, the rapist is released from the obligation to marry her (Ct. 39b).

Legislation of the State of Israel

In the State of Israel, rape is considered a criminal offense and is punishable by up to 14 years in prison, and gang rape by up to 20 years.

Any form of sexual perversion that damages the honor, dignity, physical and moral health of another person is also punishable by law; The punishment for such offenses (ma'asim megunnim, literally 'condemned actions') depends on their severity. See also Punishment.
