  • graduates of higher military educational institutions who received their first military officer rank, starting from the beginning of 2005;
  • warrant officers and midshipmen whose duration of contract military service in the army will be 3 years, starting in January 2005.

To participate in the preferential military mortgage program, a serviceman must be entered into a special register of participants in the NIS.

This register is a list of persons participating in the state mortgage program for military personnel, indicating information about these participants. Federal legislation determines that the formation and maintenance of such a register of military personnel participating in the savings and mortgage state system falls within the competence of federal executive authorities, in which Russian legislation provides for military service.

As already mentioned, today both voluntary and mandatory inclusion in this register are possible. If a serviceman voluntarily expresses a desire to participate in the program, in order to be included in the register, he needs to write a corresponding report to the commander of the military unit in which he serves.

Inclusion in the register of military personnel occurs 10 days after Rosvoenipoteka receives the relevant lists from military units.

To include a military personnel in the list of those wishing to participate in the mortgage program, you must present:

  1. Application for participation;
  2. Passport of the military personnel applying for participation;
  3. A copy of the contract.

Mechanism for implementing the mortgage program

The main idea of ​​a military mortgage is to replace the state obligation to provide housing for military personnel with the issuance of financial resources for the purchase of this housing.

The state mortgage program for military personnel of the Republic of Armenia gives military personnel the opportunity to purchase an apartment or other housing using mortgage lending at any time after three years of participation of these persons in the savings-mortgage system. Thanks to this program, Russian military personnel receive their own housing without waiting for the end of their military service.

A serviceman included in the register becomes a participant in the mortgage program. After this, he has the right to count on receiving funded contributions from the state, which he can use only in strictly defined cases by the legislator.

Each military personnel participating in the savings-mortgage system opens a special personal savings mortgage account for the state to transfer monthly cash contributions.

Such transfers for military personnel are carried out at the expense of financial resources from the federal budget. The amount of funded contributions is determined by Russian legislation and is indexed annually. Today, there are several options for military personnel to receive accumulated financial resources:

  • after 20 years of military service in the Russian army;
  • after 10 years of service in the army upon dismissal, including dismissal when a serviceman reaches a certain age, is recognized for some reason as limitedly fit for military service or as a result of a reduction that has occurred;
  • at any time after 3 years of participation in the mortgage program for the military by obtaining a targeted housing loan provided to a military personnel who participated in the state mortgage program by Rosvoenipoteka.

Obviously, the accumulated amount in a serviceman’s personal account is not always enough to purchase his own home. Therefore, many military personnel turn to banks lending under the military mortgage program for the missing amount.

The procedure for purchasing housing under the mortgage program for military personnel is similar to conventional mortgage loans. The main difference is that in order to receive a bank mortgage, a serviceman must submit to the credit institution a certificate of participation in the savings-mortgage system.

To exercise his right to a military mortgage, a serviceman who meets the requirements for participants in the state program must:

  • get into the register of persons participating in the savings mortgage system;
  • after 3 years of participation in the mortgage program, submit a corresponding report to receive a special certificate confirming the right of a military member participating in the mortgage program to receive targeted loan funds for the purchase of housing;
  • receive this certificate;
  • select suitable residential property that meets the serviceman’s own requirements, as well as the requirements of the Russian Ministry of Defense, credit institution and insurance company;
  • apply for a mortgage from a bank that provides loans to military personnel;
  • open a special account and transfer available funds from the personal savings account to it, which will become the down payment;
  • wait for the bank’s decision and sign the mortgage agreement, which is drawn up between the military personnel participating in the preferential military mortgage program, the bank issuing the loan, and the Federal State Institution “Rosvoenipoteka”;
  • conclude an appropriate transaction for the purchase of housing;
  • obtain a registration certificate.

Documents for military mortgage

To obtain bank approval for mortgage lending, military personnel usually need the following documents:

  • certificate of a military personnel on the right of an NIS participant to housing mortgage lending;
  • military ID;
  • the identity card of the serviceman applying for a mortgage and the identity card of the spouse of the serviceman, if necessary - the passport of an authorized person who has a notarized power of attorney from the purchaser of the home;
  • certificates of marriage by a military personnel (divorce), birth certificates of children;
  • a certificate from the management company from the place of registration from the applicant-military and his family members;
  • certificate of TIN of the applicant-military;
  • certificate of education of a military personnel;
  • certificates from the place of service;
  • consent from the spouse - if the participant in the military mortgage is married;
  • power of attorney - if the serviceman is not personally present at the transaction.

The bank issuing a mortgage under the government program may require other documentation to approve the loan.

  • the maximum amount allocated by the state for the purchase of housing for a military man is 2.2 million rubles, and the minimum loan amount for a mortgage issued by a bank is 300,000 rubles. The size of a mortgage loan for military personnel depends on two factors: the size of the savings contribution available in the personal account of the military member of the NIS, and the term of the mortgage. Conditions in 2016

Since 2016, there have been some changes in the housing issue for the military. The Russian Ministry of Defense has decided to abandon the practice of issuing housing “in kind,” that is, simply in the form of a house or apartment. Only those army players who signed a contract before 2005 will be able to take advantage of what existed before this moment. All housing built by the Ministry of Defense by this time was intended for them.

All other military personnel can receive an apartment or house on a military mortgage. At the same time, the state decided to dictate its own lending conditions. This means that the conditions for registration in any bank participating in the system will be almost identical. For 2016, these conditions are as follows:

  1. Mortgages for military personnel are issued for a maximum of 25 years. At the same time, at the end of this period, the borrower must be no more than 45. So if you are already 40 at the time of registration, you should not expect to extend the loan for more than 5 years.
  2. The first payment is at least 10% of the cost of the premises purchased by the army soldier.
  3. The loan rate is 12.5% ​​(on average).
  4. The maximum possible amount for housing for military personnel is 2 million 400 thousand Russian rubles.
  5. It is also possible to repay part of the debt through maternity capital and obtain an additional consumer loan on preferential terms.
  6. In order for the loan to be approved, the soldier must have continuous work experience of at least 12 months, 4 of which at his last place of work.

"Military" step by step

What happens to savings upon dismissal?

If a serviceman who retired for one of the above reasons did not manage to purchase an apartment under the program before his departure, then he has the right to the accumulated and additional funds only if his total term of service exceeds ten years. When, when the length of service is more than twenty years, the serviceman can use the savings in the account at his personal discretion, and he also has the right to additional funds. To receive funds you must complete the following steps:

  1. after reading the dismissal order, the serviceman writes an application addressed to the head of the military unit for the transfer of funds from the savings account;

  3. The application can be considered within 30 days, then the money is transferred to the details that the serviceman indicated in the application.

The right to additional funds is available to persons who do not use residential real estate under a social tenancy agreement and do not own other housing.

If such a serviceman managed to purchase a mortgage, then he is not obligated to return all the money to the CJZ, both those that were used for the down payment on the mortgage, and those that were used to repay regular payments according to the schedule and the loan agreement.

The remaining debt after dismissal can be paid off with funds that supplement savings. When additional payments are not due or are insufficient, the serviceman pays off the debt using other personal funds.

The encumbrance on the part of the state is removed upon dismissal, and the borrower decides on the issue of removing the encumbrance on the part of the bank independently after full repayment of the loan.

Upon dismissal of his own free will, due to a violation of the terms of the contract, as well as when the length of service is less than 10 years, the serviceman loses his right to savings within the framework of targeted housing financing. He must return all funds, including the first installment and monthly payments from the federal budget, to the state.

Debt repayment may not be one-time in nature. If a serviceman does not have the opportunity to return all the money at once, then he will do this over a certain period, but not more than 10 years, and in accordance with the schedule formed by the Federal State Institution "Rosvoenipoteka". In this case, the balance of the debt will be charged an interest rate equal to the discount rate of the Central Bank of the Russian Federation. The rate taken into account is the rate that was on the date when the basis for excluding the military personnel from the register of NIS participants arose.

On the part of the state, the encumbrance will be removed from the real estate when the former serviceman pays off his debt in full under the targeted housing financing agreement.

The borrower repays the entire remaining loan amount independently in accordance with the schedule provided by the bank. Accordingly, the encumbrance on the part of the bank will be excluded from the register after full repayment and closure of the loan agreement.

If a serviceman does not repay a debt

In a situation where a former serviceman does not repay his debt under the LLC, the Federal State Institution "Rosvoenipoteka" has the right to forcefully sell the housing that is pledged by applying to the courts. The residential premises will be sold forcibly within the framework of current Russian legislation.

After sale, the proceeds will be used to:

  • repayment of debt on CLP and bank loan;
  • payment of expenses associated with forced sale;
  • legal costs.

If after forced sale and all mandatory repayments there is a balance of funds, then it is credited to the personal bank account of the former serviceman, opened within the framework of the savings mortgage system. In a situation where the proceeds were not enough to repay all payments, the person remains a debtor. The debt is repaid in accordance with the procedure established by law.

What happens when a discharged service member enters into a new contract?

A serviceman who has left military service can enter into a new contract. If military service is provided for by law in this federal body, then the serviceman can be re-included in the register of the savings mortgage system. The basis for this will be a new contract.

If a serviceman was dismissed from his first place of service due to family circumstances, as a result of health conditions or organizational and staffing measures, then the accrual of contributions is resumed. For the period when the person was not in military service, contributions are not accrued. The funds that had already been accumulated before dismissal are used to pay off the debt under the targeted housing loan agreement. If there is a balance of funds after repayment, they will also be taken into account in the new savings account.

When dismissal occurs at will or as a result of a violation of the terms of the contract, the money accumulated in the account is not restored. After re-registration, the funds are used to pay off the debt on the target mortgage loan (if the mortgage has been issued).

Repayment of a mortgage from a bank at the expense of the state budget is possible when the debt on the central mortgage loan is repaid, including accrued interest and penalties.

Thus, the only risk-free option for obtaining a mortgage is the situation when a military personnel has served 20 years or more. Even if a serviceman is dismissed, he will not bear any costs. If the length of service at the time of dismissal is less than 10 years, the former serviceman may be left with debt or lose his apartment. Therefore, when deciding on this option of purchasing real estate, it is worth weighing all the risks. On the other hand, in recent years, real estate prices have been rising at a faster pace than the indexation of payments. Consequently, no one can guarantee that a serviceman will be able to buy normal housing by postponing the purchase until he has served 20 years.
